En este artículo se argumenta la importancia de la interpretación histórica en el análisis sistemático del Derecho, centrándose en el caso de los derechos de propiedad. Se destaca cómo el descuido del contexto histórico ha dado lugar a confusiones sobre las características y diferenciaciones de los institutos jurídicos. Se explica que una interpretación histórica enriquece el estudio de los derechos de propiedad en la doctrina y la jurisprudencia, permitiendo una mejor comprensión de cómo las herramientas jurídicas se han adaptado para interpretar mejor las relaciones de propiedad en diferentes sistemas políticos y económicos. Se concluye que la interpretación histórica debe ser una herramienta constante para el estudioso del derecho contemporáneo y que el análisis crítico de los contextos en los que estaban sumidos los legisladores es esencial para entender el escenario completo de la sociedad que dio a nacer las normas, con especial atención a los contextos de armonización jurídica.

W interesującej i pożytecznej monografii Tomasza Banacha poświęconej obietnicom umorzenia długów (tabulae novae), którymi Katylina starał się pozyskać przychylność rzymskiego społeczeństwa, czytelnik znajdzie stwierdzenia, w których autor wyraża silny sprzeciw wobec niektórych tendencji "marksistowskich" i "neoliberalnych". Niestety, autor nie wyjaśnia, co rozumie pod pojęciem "marksizm", ani nie cytuje literatury naukowej w celu zdefiniowania cech "marksistowskiego Katyliny". Jest to błąd, ponieważ poglądy polskich przedstawicieli doktryny marksistowskiej na temat postaci i dokonań Katyliny są analogiczne do poglądów Tomasza Banacha.

The legal position of the executor of the will under Polish and German law is very different. In particular, the text examines the rights of the executor of a will in terms of managing a commercial enterprise as a component of succession assets. It also focuses on the heir’s potential ability to prevent the executor of a will from performing their duties in accordance with the testator’s dispositions. Considerations are based on the factual circumstances presented in the BGH case No IV ZR 130/53.

Queste brevi riflessioni sui meccanismi economici e le dinamiche sociali dell’Italia romana nel I sec. d.C.  tentano di riscostruire scenari possibili attraverso il ricorso a fonti archeologiche e testimonianze letterarie, dalle quali emergono fasi di crescita e di declino: sembra così delinearsi un quadro in cui agricoltura e commercio rispondevano ad interessi fortemente interrelati non solo di mercanti e produttori in genere, ma anche di agenti economici “elitari”, quali senatori e cavalieri, i quali, dinanzi alla crisi delle esportazioni italiche – accentuatasi dalla seconda metà del I sec. d.C. – trovarono nuove forme di investimento, laddove le province mostrarono un nuovo dinamismo a scapito di Roma e dell’Italia, che “pagava” così (scil. la perdita del primato economico) la lunga supremazia politica.

The so-called Sylloge Tacticorum (ms. Laur. Plut. 55.4) preserves a collection
of several Greek and Byzantine works on warfare that date to a period between the fourth BC and the tenth century AD. On the basis of a stratigraphic analysis, this article investigates which manuscripts were used as models for the sylloge and the ratio behind the inner organization and the display of the collection.

This paper is a part of series dedicated to classical language instruction and personal development. It is a follow-up to the first part and it attempts to briefly outline the state of teaching of classical languages in the first half of the 20th century. To some extent, the paper also examines how classical education was reflected in the society, how it formed the personalities of individuals and how it correlated with the ideas of newly established Czechoslovakia. In regards to the methodology, efforts to change the approach were much more common in this period. It seemed that the grammar-translation approach, which had been prevailing originnally, was not bringing the desired results and that it was necessary to at least reform it. Direct method was introduced, too. A comparison of these two methods creates the body of this paper.

Článek ze série věnované klasickému vzdělání a rozvoji osobnosti navazuje na první část a pokouší se stručně ukázat stav výuky klasickým jazykům v první polovině 20. století. V určité míře sleduje také to, jak se klasické vzdělání promítalo ve společnosti, jak formovalo osobnosti občanů a jak korelovalo s idejemi nově vzniknuvšího Československa. Pokud se metodologie týká, objevují se v tomto období mnohem hojněji snahy o změnu přístupu. Zdá se totiž, že původně zcela dominantní gramaticko-překladová metoda nepřináší kýžené výsledky a že je nutné ji přinejmenším reformovat. Na scénu se také dostává metoda přímá. Jejich srovnání se věnuje většina obsahu příspěvku.

Analiza politycznej wyobraźni instytucjonalnej w X i XI wieku, czyli w okresie formowania się obecnej mapy politycznej Europy. Tezą książki jest trwałość antycznych instytucji ustrojowych, niedoceniana i niezauważana przez mediewistów, co czyni ich bezradnymi wobec fenomenu podwójnej (1000 r. i 1025 r.) koronacji Bolesława Chrobrego. Książka jednocześnie jest napisana w formie polemiki z krytykami poprzedniej książki Kozickiego, której tezy i ostrze krytyki zostały streszczone na pierwszych kilku stronach. Luminarzami, z którymi fechtuje autor są: profesor Jacek Banaszkiewicz (mediewista, specjalista od Karolingów i Liudolfingów), profesor Stanisław Suchodolski (numizmatyk, specjalista od monet z czasów Chrobrego) i profesor Paweł Żmudzki (źródłoznawca, specjalista od kronik owej doby).

Roman law is the legal system of ancient Rome, including the legal developments spanning over a thousand years of jurisprudence, from the Twelve Tables (449 BC), to the Corpus Juris Civilis (AD 529) ordered by Eastern Roman Emperor Justinian I. Roman law served as a basis for legal practice throughout Western continental Europe, as well as in most former colonies of these European nations, including Latin America, and also in Ethiopia. English and Anglo-American common law were also influenced by Roman law, notably in their Latinate legal glossary (for example, stare decisis (precedents), culpa in contrahendo (fault in conclusion of contacts), pacta sunt servanda (agreements must be kept).

El oficio de la nodriza en el mundo romano ha suscitado un gran interés por parte de la investigación histórica en las últimas décadas, y ha generado una amplia bibliografía. En algunos de estos trabajos se han destacado las relaciones afectivas que se establecieron entre nutrices et nutriti, documentadas en la literatura, así como en la rica epigrafía de tipo principalmente funerario que ambos grupos se dedican entre sí. El objetivo de este texto es presentar las características generales de un conjunto no poco numeroso de inscripciones que permiten ver cómo se conmemoran respectivamente nutrices y nutriti. Igualmente se intenta mostrar cómo se construye la imagen de este vínculo través del registro epigráfico, mediante el uso de un léxico relacionado con el mundo de los afectos

Mit der systematischen Behandlung praktisch allgegenwärtiger Ausnahmen ringt die Rechtslehre um die Einheit ihres Rechts. Dieses Ringen wird besonders plastisch, wenn es darum geht, Widersprüche zwischen verschiedenen Ausnahmen aufzuheben. Diese Aufgabe stellt sich eine Disputation, die der Jurist Samuel Stryk 1684 in Frankfurt an der Oder abnahm und dann publizierte. Sie trägt den Titel: „De Jure Privilegiati contra Privilegiatum“. Es geht dabei um das Problem der Kollision von Privilegien, ein schillernder Begriff, dessen Weite das Projekt zu einem Himmelfahrtskommando macht.

Opracowanie poświęcone jest analizie przywileju nadanego żołnierzom armii rzymskiej przez cesarza Hadriana w odniesieniu do prawa dziedziczenia przez ich dzieci pochodzące ze związ­ków pozamałżeńskich. Począwszy od I w. n.e., żołnierze służący w legionach nie mogli zawrzeć ważnego małżeństwa. Wprowadzenie takiego uregulowania tłumaczy się najczęściej troską o utrzymanie disciplina militaris. W konsekwencji związki żołnierzy posiadających obywatel­stwo rzymskie z obywatelkami rzymskimi lub peregrynkami nie rodziły żadnych skutków praw­nych, nawet mimo potencjalnego istnienia conubium pomiędzy partnerami. Dzieci pochodzące z takich związków (liberi illegitimi) nie wchodziły pod władzę swoich ojców ani nie nabywały praw spadkowych w jego rodzinie. Żołnierz mógł jedynie powołać do dziedziczenia pozamał­żeńskie dziecko, mające status prawny Latyna lub peregryna, sporządzając testament żołnierski (testamentum militis). In the article there are determined some preconditions of the modern concept of a legal person in Ancient Rome. Researching is preceded by historiographical review aiming to summarize investigation of roman law of persons in the last centuries. The appearance of the notion “persona” is contextualized basing on ancient drama and rhetoric. The features of using that term are exemplified with texts by Gaius and Iulianus. It is
concluded that ancient rhetoric made a contribution in developing of abstract view on legal person as a part of systematization of roman law. Meanwhile it is underlined the connection between perception of ancient scenic images and intuitive approach to finding legal solution.

Temeljna je intencija rada promisliti o skrbništvu u rimskom pravu. Za lakše razumijevanje navedenog instituta skrbništva u pravu, prvi dio rada je namijenjen objašnjenju pojma skrbništva te podjeli instituta skrbništva (tutorstvo – tutela i kuratorstvo – cura). Nakon navedene podjele, drugi dio posvećen je detaljnim pojašnjenima tutorstva, na koje se dalje nadovezuju tutorstvo nad nedoraslima, prava i dužnosti tutora, ograničenja prava tutora, tutorstvo nad ženama, oblici tutorstva (tutela legitima, tutela testamentaria, tutela dativa), prestanak tutorstva, dok je treći dio posvećen drugom institutu skrbništva – kuratorstvu te nadalje vrstama kuratorstva (cura furiosi, cura prodigi, cura minorum). Ostali oblici skrbništva razrađeni su u četvrtom dijelu. The Early Modern Environment: The History of Philosophy as Anachronistic Practice

According to Timothy Morton, there is a contradiction at the very heart of discussions on the environment. When we talk of “environment”, we bring to the foreground something that by definition is supposed to stay in, or rather, be, the background. Yet, the idea that the environment is a kind of canvas on which our actions take place, is a recent one. In the first attested usages of the term “environment”, in 15th-century French, the meaning was closer to that of “proximity”, or “the state of being encompassed, surrounded”. In 17th-century Italian, “ambiente” could mean a kind of fluid surrounding bodies. In German, the word often considered as the direct translation of “environment”, “Umwelt”, contains in itself the word “world”. A world is an all-encompassing totality, which resists being confined to the background (and for this reason, the English translation of a work by Jakob von Uexküll, who introduced the concept of “Umwelt” into biological sciences, occasionally translates it with “world”, and not with “environment”).
This workshop focuses attention on early modernity in order to ask: what did ‘environment’ mean before it came to signify the background, or context for human action? What were the philosophical implications of conceiving such a close relationship between human beings and their environments? Further, what did it mean to take care of the environment before the recent ecological turn?
This workshop takes the topic of a philosophical history of the environment, and of environmental care, to pose broader methodological questions: is it possible to write a history of philosophy, which is in dialogue with contemporary issues, and is nevertheless attentive to philology and contextualisation? How do we trace nuanced lines of conceptual change amidst constant terminological variation, especially from a multilingual and intercultural perspective? And finally, based on the topic of environmental care, is an anachronistic history of philosophy possible, and even necessary?
